Welcome to Caffy platform, which is owned and operated by Section 0 Inc. ("Caffy.io," "Caffy," "Company," "we," or "us"). These terms of service (which includes our Privacy Policy) (“Terms of Service”) are a contract between you and Caffy. By using caffy.io (the "Site"), creating your Caffy account and using the Site or our mobile applications to post various content to the Caffy community, including stories you create, comments and messages, or to access and view Caffy content or other user content (together with the Site, the “Services”), you’re agreeing to these Terms of Service. If you don’t agree to any of these terms, you can’t use Caffy Services.
Caffy Services are only for people 13 years old and over. If we learn someone under 13 is using Caffy Services, we’ll terminate their account.
Caffy provides interactive stories, conversations, characters, images, and narrative experiences that are generated by artificial intelligence ("AI") or created with the assistance of AI (individually and collectively, "AI Content"). You acknowledge and agree that:
All characters, conversations, stories, and responses on the Caffy are generated by AI, fictional in nature, and intended solely for entertainment and creative storytelling purposes.
AI Content does not represent real persons, real events, or real relationships, and must not be interpreted as factual information, professional advice, diagnosis, prediction, or guidance of any kind. No chatbot, character, or narrative experience on Caffy is operated by, controlled by, or representative of a real person.
AI Content may simulate human-like dialogue, emotions, or interpersonal dynamics; however, these interactions are purely artificial and fictional, and do not constitute real human communication, emotional support, or a replacement for real-world relationships.
Where required by applicable law, Caffy will provide clear and conspicuous notices reminding users that they are interacting with artificial intelligence.
You can’t browse very much on Caffy or use the Services without registering for an account. To get the most out of the Caffy platform, you’ll need to register, choose an account name, and set a password.
You’re responsible for all the activity on your account, and for keeping your password confidential. If you share your account information with anyone, that other person may be able to take control of the account, and we may not be able to determine who is the proper account holder. We will not have any liability to you (or anyone you share your account information with) as a result of your or their actions under those circumstances. If you find out that someone’s used your account without your permission, you should report it at hello@caffy.io.
By agreeing to create an account, you agree to receive our email notifications to the e-mail address you provide to us. These notifications may be about your account, changes to our service, or other updates or marketing relating to our platform. You may unsubscribe from our email list.
Before posting any content to Caffy, it is important that you read our Content Guidelines. The content on the Service includes videos, audio (for example music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials whether provided by you, Caffy, or a third-party (collectively, "Content").
If your Content does not comply with the Terms of Service or the law, it may be removed at any time.
You own all the rights to the Content you create and post on Caffy Services. Of course, if the Content wasn’t yours to begin with, putting it on Caffy doesn’t make it yours. Don’t submit Content you don’t hold the copyright for (unless you have permission, including to grant Caffy all rights outlined in these terms).
You’re responsible for the Content you post. This means you assume all risks related to its publication and display, including someone else’s reliance on its accuracy and any claims relating to intellectual property or other legal rights.
By providing Content to the Service, you grant Caffy a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use that Content (including to reproduce, distribute, prepare derivative works, display and perform it) in connection with the Service and Caffy’s (and its successors’ and Affiliates’) business, including for the purpose of promoting and redistributing part or all of the Service.
You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your Content through the Service. This license does not grant any rights or permissions for a user to make use of your Content independent of the Service.
The licenses granted by you continue for a commercially reasonable period of time after you remove or delete your Content from the Service.
You may remove your Content from the Service at any time. You must remove your Content if you no longer have the rights required by these terms.
If you believe that your Content has been copied in a way that constitutes copyright infringement, please contact us via email at hello@caffy.io.
In your use of the Services you may enter into additional terms and conditions and other agreements that alter or override these Terms of Service, such as when you enter a contest or join a special program with Caffy. In case of any conflict or inconsistency, the terms and conditions of those additional terms and agreements would override these Terms of Service.
You are granted a non-transferable, non-exclusive, revocable, limited license to access and use the Service for your own personal, non-commercial use.
The following restrictions apply to your use of the Service. You are not allowed to:
access, reproduce, download, distribute, sell, license, alter, modify or otherwise use any part of the Service or any Content for any purpose except: (a) as expressly authorized by the Service; or (b) with our prior written consent and the consent of the copyright holder.
circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Service, including security-related features or features that prevent or restrict the copying or other use of Content or limit the use of the Service or Content.
use temporary, disposable, or one-time email addresses to create accounts or access the Service, in which cases we reserve the right to suspend or terminate accounts created using such email addresses (you may contact hello@caffy.io within 3 business days, if you believe your account has been incorrectly blocked).
access the Service using any automated means (such as robots, botnets or scrapers) except (a) in the case of public search engines, in accordance with our robots.txt file; or (b) with our prior written permission;
collect or harvest any information that might identify a person (for example, usernames or faces), unless permitted by that person or allowed under the above section;
use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations;
cause or encourage any inaccurate measurements of genuine user engagement with the Service, including by paying people or providing them with incentives to increase the number of chats, messages, or favorites, or to increase a user's follower count, or otherwise manipulate metrics in any manner;
misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions;
use the Service to transmit, distribute, store or display any unlawful, harassing, abusive, tortious, threatening, harmful, defamatory Content.
Using the Service does not give you ownership of or rights to any aspect of the Service, including user names or any other Content posted by others or Caffy.
We reserve all rights in the Sites’ and the Services look and feel, and in our content. You may not copy or adapt any portion of our code or visual design elements (including logos) without express written permission from Caffy or as set out in this clause. Please do not use our logo or trademarks in any way that might suggest Caffy endorses a particular product or service, or you have a business relationship with Caffy.
Caffy may change, terminate, or restrict access to any aspect of the Services, at any time, without notice. We can remove any Content you post or submit for any reason. Caffy may access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms of Service, including investigation of potential violations, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of the Services, its users and the public.
You can terminate your Caffy account at any time by contacting us via email at hello@caffy.io.
We may suspend or terminate your account or cease providing you with all or part of the Services if (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we reasonably believe that there has been conduct that creates (or could create) liability or harm to any user, other third party, Caffy or our Affiliates.
Caffy is expressly designed and operated for the purpose of:
Providing fictional interactive storytelling and narrative entertainment;
Enabling creative exploration of user-driven, choice-based fictional scenarios.
The Service is not designed or intended to function as:
A medical or mental health system;
A diagnostic, therapeutic, or crisis-intervention tool;
A system supporting real-world decision-making in regulated or high-risk domains;
A system that evaluates, scores, or makes determinations about individuals' health, safety, or legal status.
The Company designs and operates the Service to avoid classification as a high-risk AI system under Regulation (EU) 2024/1689 (EU AI Act) and related applicable frameworks.
Caffy is not intended for, nor targeted toward, individuals who:
Are experiencing acute psychological distress, crisis, or mental health emergency;
Require clinical diagnosis, treatment, or therapeutic intervention;
Are under the age of 13;
Are otherwise considered vulnerable users under applicable law, including persons with disabilities requiring specific accessibility accommodations beyond general web accessibility standards.
The Company does not market, position, or operate the Service as suitable for such users and expressly disclaims any intended use in these contexts. Caffy is not designed to exploit vulnerabilities of vulnerable groups and does not knowingly target or collect data from vulnerable populations for purposes beyond general entertainment provision.
No Medical or Mental Health Advice. AI Content on Caffy is provided for storytelling, entertainment, and creative purposes only. It is not intended to provide medical, psychological, psychiatric, or mental health advice, diagnosis, or treatment.
No Reliance in Crisis Situations. You agree not to rely on Caffy or its AI Content for support during emotional distress, suicidal ideation, or self-harm thoughts.
Crisis Resources. If you or someone you know is experiencing suicidal thoughts or emotional distress, seek immediate professional help. In the United States, call or text 988. Local crisis resources may be provided where legally required.
Safety Interventions. Caffy may deploy automated safety mechanisms to detect and respond to expressions related to self-harm or suicide, including displaying crisis resources or limiting certain interactions.
You acknowledge that AI systems may produce inaccurate or incomplete responses and that Caffy is not responsible for decisions made based on AI Content.
Caffy does not promote, encourage, glorify, or provide instructions for self-harm, suicide, or self-destructive behavior. If your input or interaction indicates potential self-harm or suicide risk, Caffy may:
Restrict or block the generation of harmful or explicit content;
Provide neutral, safety-oriented responses; and
Display information encouraging the user to seek professional help or local crisis support resources.
Caffy is not a crisis intervention system and does not provide emergency assistance. In the event of an emergency or immediate danger, you must contact local emergency services or qualified professionals immediately.
If you are experiencing distress and are considering self harm, help is available by texting or calling the Suicide and Crisis Lifeline at 988 (US only, international numbers can be found here).
OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT OR AS REQUIRED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" BASIS AND CAFFY DOES NOT MAKE ANY SPECIFIC COMMITMENTS OR WARRANTIES ABOUT THE SERVICE. FOR EXAMPLE, WE DON'T MAKE ANY WARRANTIES ABOUT: (A) THE CONTENT PROVIDED THROUGH THE SERVICE; (B) THE SPECIFIC FEATURES OF THE SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS; OR (C) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON THE SERVICE.
EXCEPT AS REQUIRED BY APPLICABLE LAW, CAFFY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS; LOSS OR CORRUPTION OF DATA; INDIRECT OR CONSEQUENTIAL LOSS; PUNITIVE DAMAGES CAUSED BY:
ERRORS, MISTAKES, OR INACCURACIES ON THE SERVICE;
PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE;
ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE;
ANY INTERRUPTION OR CESSATION OF THE SERVICE;
ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
ANY CONTENT WHETHER SUBMITTED BY A USER OR CAFFY, INCLUDING YOUR USE OF CONTENT; AND/OR
THE REMOVAL OR UNAVAILABILITY OF ANY CONTENT.
THIS PROVISION APPLIES TO ANY CLAIM, REGARDLESS OF WHETHER THE CLAIM ASSERTED IS BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Caffy, its Affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of the Service.
The Service may contain links to third-party websites and online services that are not owned or controlled by Caffy. Caffy has no control over, and assumes no responsibility for, such websites and online services. Be aware when you leave the Service; we suggest you read the terms and privacy policy of each third-party website and online service that you visit.
Changing this Agreement
We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. Any such changes will become effective no earlier than 14 days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms.
Continuation of this Agreement
If your use of the Service ends, the following terms of this Agreement will continue to apply to you: "Other Legal Terms," "About This Agreement," and the licenses granted by you will continue as described under "Duration of License."
Severance
If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.
No Waiver
If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have (such as the right to take action in the future).
Interpretation
In these terms, "include" or "including" means "including but not limited to," and any examples we give are for illustrative purposes.
Governing Law
These Terms of Service and your use of the Services are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.
Dispute Resolution
Any dispute arising out of or relating to these Terms shall first be discussed in good faith by the parties. If not resolved within 30 days, it shall be finally settled by arbitration administered by the Singapore International Arbitration Centre (SIAC) under its Rules, with Singapore as the seat and English as the language. Either party may seek temporary or injunctive relief from a competent court pending arbitration, and all arbitration proceedings and awards shall remain confidential. Each party shall bear its own legal and expert fees, unless otherwise decided by the tribunal.
Limitation on Legal Action
YOU AND CAFFY AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
